  1. Information on how to enter and prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.

  2. Entry is open to all residents of Australia aged 18 years who create an account with TALULAH at the TALULAH eBoutique (via the methods outlined below in clause 4) between 10/02/2014 and 11:59pm AEDST on 30/03/2014 (inclusive). Entry is subject to verification through an email sent to the provided email address of the Account holiday to confirm that account. Employees and their immediate families of the Promoter and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.

  3. The promotion commences 10/02/2014 and closes 11:59pm AEDST on 30/03/2014 (“Promotional Period”).

  4. To receive an entry, entrants must during the Promotional Period need to:

    • Visit and create an Account at the eBoutique
    • Enter in 25 words or less in the provided section on the Create an Account page “What TALULAH piece would you take with you on a holiday to Fiji to Live The Indian Summer?”
    • To ensure that your Account is successfully set up and that you have entered the competition successfully, please refer to the confirmation email sent to your email address of which you provided at Account Registration
  5. If an entrant creates an account on behalf of a friend as a gift, the person who receives the confirmation email and information is on the account will be entered into the competition.

  6. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.

  7. The Promoter reserves the right, at any time, to verify the validity of all entries and entrants (including an entrant’s name, age and place of residence) and to disqualify any entrant who tampers with the entry process, or who submits an entry that is not in accordance with these Terms and Conditions. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

  8. Incomplete or indecipherable entries will be deemed invalid.

  9. Multiple entries are not permitted, subject to the following: (a) unless otherwise stated by the Promoter, only one (1) entry is permitted per account; and (b) each entry must be submitted separately and in accordance with entry requirements, (c) only one account can be created per entrant and multiple accounts with varying contact details will not be accepted as an additional entry into the drawer for that person.

  10. The winner will be selected based on the skill of their answer and will take place at TALULAH of Level 1, 64 Centennial Circuit Byron Bay NSW 2481 at 11:00am AEDST on 31/3/2014. The grand prize winner will be notified in writing by email and verbally by phone within one (1) business day of the prize selection and their names will be published online through TALULAH and ISLA social media channels including Instagram, Facebook and the TALULAH blog.

  11. The Promoter’s decision is final and no correspondence will be entered into.

  12. The first (1) valid entry will win a trip for two (2) adults to Denarau Island, Fiji valued at up to AU$10,000 depending on date and point of departure. The prize will be given as a $10,000 Travel by Wyndham Voucher which will include:

    • Two (2) x return economy airfares flying Virgin Australia from Sydney International Airport to Nadi, Fiji . The winner and their companion must make their own way (at their own cost) to the Sydney International Airport;

    • Return airport transfers for two (2) people;

    • Six (6) nights’ accommodation staying at Wyndham Resort Denarau Island in a brand new luxurious 3-bedroom Presidential villa with private plunge pool overlooking the ocean.

    • Spending money (unused portion of $10,000 Voucher after flights & accommodation are booked) can be used towards various activities including booking a cruise around the Fiji Islands, spa packages and any activities/tours that can be arranged by the resort.

Jet ski, dive, snorkel or take a cruise, all arranged by the Resort at your request. Resort inclusions:

  14. All events, tours, and dates subject to change without notice. Other restrictions may apply.

  15. Each winner and their companion must travel together on the same dates & routing. Each winner and their companion must make their own way to Sydney International Airport for flight departure. Costs associated with travel to and from Sydney International Airport are the responsibility of the winners and their companions.

  16. Spending money, meals, taxes (excluding airline and airport taxes), insurance, passports, visas, vaccinations, transport to and from departure point, additional transfers, items of a personal nature, in-room charges and all other ancillary costs are not included.

  17. Each prize is valid through to 16 December 2014 (subject to booking and flight availability).

  18. In the event that a portion of a prize is awarded to the winner in the form of a voucher / ticket / pass, redemption of that portion of the prize will be subject to the terms and conditions stipulated on the voucher / ticket / pass. The Promoter will not be liable for any voucher / ticket / pass that has been lost, stolen, forged, damaged or tampered with in any way.

  19. Prizes are non-transferrable/non-exchangeable/non-replaceable/non-upgradeable and cannot be taken as cash.

  20. No extension on the validity date of prizes will be permitted. Once booked, any changes made to the booking may incur a cancellation fee or amendment fee at the cost of the winner.

  21. Each winner and their companion are responsible for ensuring that they have valid passports, and any requisite visas, vaccinations and required and travel documentation. Each winner (and their companion) must depart from and return to the same point of departure and travel together. Frequent flyer points will not form part of the prize. Standard conditions for tickets and accommodation apply. The winner may be required to present credit card at time of check in at accommodation. Prize is subject to the standard terms and conditions of individual prize and service providers.

  22. Total prize is valued up to AU$10,000.

  23. If the winner wishes to stay longer than six (6) nights in Fiji or at an accommodation not nominated by the Promoter, all additional costs incurred will be the winner’s responsibility.

  24. The Promoter recommends that the winner obtain travel insurance, however, this is not a mandatory requirement and any costs to do so will be at the winner’s personal expense and the expense of their companion.

  25. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law to (a) disqualify any entrant; and/or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.

  26. Subject to the unclaimed prize draw clause, if for any reason a winner does not take a prize or an element of a prize by the time stipulated, then the prize or that element of the prize will be forfeited.

  27. If a prize (or part of a prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.

  28. In the event of unforeseen circumstances, the Promoter reserves the right to offer an alternative prize of equal or greater value. In the event of war, terrorism, state of emergency or disaster (including natural disaster), the Promoter reserves the right to either provide an alternative travel prize (including an alternative destination as specified by the Promoter) to the same value as the original prize or, subject to any applicable laws or written directions made under applicable legislation, to cancel, terminate, modify or suspend the promotion.

  29. It is a condition of accepting a prize that the winner (and their companion) may be required to sign a legal release in a form to be determined by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.

  30. Any cost associated with accessing the promotional websites is the entrant’s responsibility and is dependent on the Internet service provider used. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.

  31. Entrants consent to the Promoter using the entrant's name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.

  32. The Promoter is not responsible for any incorrect or inaccurate information, either caused by the phone user or for any of the equipment or programming associated with or utilised in this competition, or for any technical error, or any combination thereof that may occur in the course of the administration of this competition including any omission, interruption, deletion, defect, delay in operation or transmission, communications line or telephone, mobile or satellite network failure, theft or destruction or unauthorised access to or alteration of entries.

  33. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.

  34. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) taking/use of a prize.

  35. The Promoter collects personal information in order to conduct the promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, prize suppliers, to publish the winner's name and locality as required under the relevant lottery legislation and, as required, to provide winner’s information to Australian regulatory authorities without any further reference or payment or other compensation to the entrant. Entry is conditional on providing this information. The Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. Collection, use and disclosure of information collected in connection with this promotion is governed by the Privacy Notice available at in the Privacy Policy section of the website. Entrants should direct any request to access, update or correct information to the Promoter. All entries become the property of the Promoter.
